1. Acceptance of Terms
   By accessing or using the 1+ mobile app, website, or related services, you agree to these Terms & Conditions (“Terms”), our Privacy Policy, and our Refund Policy. If you do not agree, you may not use our services.

2. Purpose & Mission
   1upstairs exists to create a positive impact in communities. Purchases, memberships, and app usage are contributions that support our mission, not simply commercial transactions. By engaging with 1+, you are joining a community built on shared purpose and contribution.

3. User Accounts
   You must be at least 18 years old (or have parental/guardian consent if younger) to create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials. We reserve the right to suspend or terminate accounts for misuse, non-compliance, or conduct inconsistent with our mission and values.

4. Acceptable Use
   You agree not to use 1+ for unlawful, harmful, or fraudulent purposes. You agree not to interfere with or disrupt the platform or servers. You agree not to misrepresent your identity or affiliation with any person or organization. You agree not to post or share inappropriate, offensive, or harmful content.

5. Contributions, Sales, Refunds & Discounts
   All purchases through 1upstairs and 1+ are considered contributions toward our mission. As outlined in our Refund Policy, all sales are final, with refunds or exchanges only available for defective products. Discounts and promotions are limited to one coupon per order, with eligibility to combine with sale prices, automatic discounts, or free shipping determined by store policy.

6. Volunteer & Contractor Placement
   Background checks may be required by partner organizations. 1upstairs is not responsible for the actions of third-party organizations or individuals. You agree to represent yourself and 1upstairs with integrity and in alignment with our community standards.

7. Intellectual Property
   All content, logos, trademarks, and materials in the App and on our website are owned by or licensed to 1upstairs. You may not copy, distribute, modify, or create derivative works without our written consent.

8. End User License Agreement (EULA)
   As an end user of 1+, you are granted a license to install and use the App on your device. You may not reverse-engineer, decompile, or attempt to extract source code. You may not use the App in a way that violates laws, infringes on intellectual property, or disrupts others. This license is revocable at any time for breach of these Terms.

9. Termination of Use
   We may suspend or terminate your access to 1+ at our discretion if you violate these Terms, misuse the platform, or act in a way that undermines our mission.

10. Limitation of Liability
    1upstairs provides 1+ “as is” and “as available.” We make no guarantees about uninterrupted or error-free service. To the fullest extent permitted by law, 1upstairs is not liable for indirect, incidental, or consequential damages arising from your use of 1+.

11. Privacy
    Our collection and use of your data are governed by our Privacy Policy, which is incorporated into these Terms.

12. Changes to These Terms
    We may update these Terms periodically. Continued use of 1+ indicates acceptance of the updated Terms.

13. Governing Law
    These Terms are governed by the laws of the State of Illinois.

Refund Policy

1. Our Commitment
   Every purchase supports our mission. Because your support fuels programs, all sales are final.

2. Eligibility for Refunds/Exchanges
   We offer refunds or exchanges only for manufacturing defects. To qualify, the item must be unused, in original packaging, and returned within 7 days. Proof of purchase is required.

3. Return Process
   If you receive a defective product, contact us at contact@1upstairs.com with your order number, a description of the defect, and photos. If approved, we will provide return instructions. Refunds or replacements will be processed after inspection.

4. Non-Refundable Situations
   Refunds or exchanges are not available for change of mind, incorrect sizing (unless due to manufacturing error), normal wear and tear, or damage caused by misuse, neglect, or modification.

Waiver, Release & Assumption of Risk

   Volunteers act independently and are not employees or agents of 1upstairs. The platform serves only as a connector.

2. Eligibility & Age
   Participants must be 18 or older and attest to their eligibility. Misrepresentation may result in termination.

3. Voluntary Participation & Risk
   All participation involves inherent risks, including injury, illness, or property damage, which participants voluntarily assume.

4. General Release
   Participants release 1upstairs from liability for activities, third-party conduct, or negligence.

5. Third-Party Organizations
   1upstairs is not liable for experiences with external organizations connected through the platform.

6. Background Checks
   Background checks may be required by partner organizations. 1upstairs is not responsible for their results or decisions.

7. Indemnification
   Participants agree to indemnify and hold 1upstairs harmless from claims arising from their own actions or third-party interactions.

8. Medical Treatment
   Participants consent to emergency treatment at their own expense.

9. Arbitration & Governing Law
   All disputes will be resolved through binding arbitration under Illinois law.

10. User Data Visibility
    Certain profile information may be visible to partnering organizations for matching and safety purposes.

11. Severability & Entire Agreement
    If any part is unenforceable, the rest remains valid. This Agreement is the full understanding between the parties.

12. No Warranty & Limitation of Liability
    The platform is provided “as is.” 1upstairs is not liable for indirect or consequential damages.

13. Modifications
    We may modify this Agreement at any time. Continued use signifies acceptance.

14. Electronic Acceptance
    By clicking “I Agree” or using the platform, participants consent to this Agreement.

15. 3:10 Program Disclosure
    Membership proceeds may be allocated by 1upstairs to charitable causes through the 3:10 Program. These are not personal donations and are not tax deductible. 1upstairs retains discretion over distribution.
